1. What these terms cover
These terms govern your use of the OpsHarbor website and any enquiry you submit through it.
They are not your service contract. If you become a client, a Master Services Agreement and a Statement of Work for each service govern the work, and those documents take precedence over anything on this page. Nothing here creates an obligation for us to provide services.
2. What we do, and what we do not do
We build and operate AI phone agents that perform administrative calling for non-medical home care agencies: screening applicants, answering after-hours family enquiries, filling open shifts, chasing clock-ins, and tracking credential expiry.
We are not a healthcare provider and our agents do not practise care. They do not give care advice, do not assess a client, and do not discuss a plan of care. If a caller needs clinical help the agent hands off to a human.
We do not guarantee hire rates, fill rates, or any particular business outcome. Where this site quotes figures about caregiver turnover or recruiting cost, those are industry figures used to explain the problem, not a prediction about your agency.
3. Enquiries and AI calling consent
When you submit a form with a phone number and tick the consent box, you agree that we may contact you at that number, including by automated or AI-generated voice calls and text messages, about your enquiry, and that calls may be recorded.
Consent is not a condition of purchase. You can withdraw it at any time. Details of how we handle those calls and recordings are in the Privacy Policy.
You confirm that the phone number you give us is one you are entitled to receive calls on, and that you are authorised to enquire on behalf of the agency you name.
4. If you become a client, what we need from you
These are the obligations that decide whether the service can work at all, so they are listed here rather than buried:
- Consent language. You deploy the wording we supply on your application form and onboarding packet, so we can lawfully call your applicants.
- Scheduler access. You provide API access or an agreed alternative to your scheduling system.
- Screening requirements. You tell us what a qualified applicant looks like for your agency.
- A named contact. One person who can answer questions and approve changes.
We cannot deliver the service without the first two, and a refusal to deploy consent language is a reason we will decline the work rather than proceed and expose you.
5. Acceptable use of this site
Do not submit false contact details, submit someone else's number without their permission, attempt to break or overload the site, or scrape it. We rate-limit submissions and use a hidden field to filter automated spam.
6. Intellectual property
The site, its content, and the agent builds, prompts and workflows we create remain ours. Your data, your applicant and caregiver records, and your call transcripts remain yours. Becoming a client does not transfer ownership of our tooling to you, and does not give us any claim over your data.
7. Confidentiality
What you tell us during an enquiry or a discovery call is treated as confidential and used only to work out whether we can help you and how.
8. Limitation of liability
The site is provided as-is. To the fullest extent the law allows, we are not liable for indirect or consequential loss, lost profit, or lost business arising from your use of this site or reliance on anything published on it. Nothing in these terms limits liability that cannot lawfully be limited.
Liability arising from paid services is dealt with in the Master Services Agreement, not here.
9. Governing law
These terms are governed by the laws of the State of Florida, and any dispute will be brought in the courts of Florida.
10. Changes
We may update these terms. The date above shows when they last changed. Continuing to use the site after a change means you accept the updated terms.
